IMPORTANT: Please read and agree to these terms and conditions before installing and using a copy of this software. If you do not accept the license terms set out in this agreement, you must cancel the installation process and delete the software from your computer. Use of the software indicates acceptance of these terms

1. Introduction

(i) This User Agreement is an agreement between you, Chilipoker and the Tain Poker Network that governs and defines your use of the Tain Poker Network. The Tain Poker Network operates under a license granted by Kahnawake Gaming Commission. The regulations concerning this can be viewed from this link.

2. Legality of Participation in Games

You may only participate in the Games provided by Chilipoker and the Tain network if you are over 18 years of age (or such other minimum legal age in the jurisdiction where you are connecting) and it is legal for you to do so according to the laws that apply in the jurisdiction from where you are connecting from (this may change according to the country/state that you are in). You understand and accept that Chilipoker and the Tain Network is unable to provide you any legal advice or assurances and that it is your sole responsibility to ensure that at all times you comply with the laws that govern you and that you have the complete legal right to play the Games. Any participation in the Games provided by the Chilipoker and the Tain Network is at your sole option, discretion and risk. Further, neither Maltese nor residents of Malta are permitted to use the Service. By playing the Games, you acknowledge that you do not find the Games or any Services provided by Chilipoker and the Tain Network to be offensive, objectionable, unfair, or indecent in any way.

(i) You may only have one account, for which you will register using your own, correct name. You may not use the Service by means of another person's account. Should you attempt to open more than one account, under your own name or under any other name, or should you attempt to use the Service by means of any other person's account, we will be entitled to immediately close all your accounts and bar you from future use of the Service.

3. Registration

To play on our pokersite, you will first need to download and install our Software and register for an account with us (an "Account") by choosing a unique Account name and password and entering other information that we ask for on our registration form such as (but not limited to) your first and last name, address, email, gender, birth date and telephone number. You agree to provide only true, complete and current information and you further agree to update this information as necessary to keep it true, complete and current.

4. Your Representations

You confirm and agree that:

(i) Your Chilipoker account is for your sole, personal use only and it is not to be used by you or any third party for the purpose of or in the course of any trade or business.

(ii) You shall not allow any third party to use your account, password or identity to access or use the Service or the Software. You shall not allow any person under the age specified in 2. above, any form of access to the Service or Software.

We take no responsibility for any third party access to your account.

(iii) You fully understand the methods, rules and procedures of the Service and Internet gambling in general and your use of the Service and Software will be made exclusively in accordance with this Agreement and the Rules. You will not commit any acts or display any conduct that damages the reputation of Chilipoker or the Tain Poker Network.

(iv) You acknowledge that in registering and using the Service you have to provide us with certain personal details about yourself. While we will keep this information confidential, you agree that it may be necessary, from time to time, for us to disclose certain of these details to third parties and you consent to such disclosures. Please see our Privacy Policy for further information.

5. Intellectual Property

(i) Chilipoker and the Tain poker network hereby grants you the non-exclusive, non-transferable right to use our software, including any software downloadable from the Site and all content derived from the software, including the copyright and all intellectual property rights therein (the "Software"), in connection with the Service in accordance with this Agreement.

(ii) The Service is made available for your personal use only. Any other use is strictly prohibited.

(iii) The Software's structure, organisation and code are the valuable trade secrets of the Tain poker network and/or its group Companies and/or its licensors. You obtain no rights to the Software except to use it in accordance with this Agreement. Save as expressly permitted by law, you are strictly prohibited from, and agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software or any part of it or to create, publish or distribute derivative works from the Software. You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any applicable laws, restrictions or regulations.

6. Play Money Account Funding

"Play money" accounts are funded with 1,000 "play money" chips. If a player runs out of "play money" chips can add more "play money" chips by clicking on "Get more chips" on the lobby.
"Play money" chips have no value in and of themselves. They are neither transferable to a "real money" account nor redeemable for any currency.
"Play Money" chips cannot be exchanged for cash or any valuable thing.

7. No warranties and limited liability

(i) YOUR ACCESS TO THE TAIN POKER NETWORK, DOWNLOAD OF THE SOFTWARE AND PARTICIPATION IN THE GAMES IS AT YOUR SOLE OPTION, DISCRETION AND RISK. Chilipoker or THE Tain Poker Network SHALL NOT BE LIABLE FOR COMPUTER MALFUNCTIONS NOR ATTEMPTS BY YOU TO PARTICIPATE IN THE GAME BY METHODS, MEANS OR WAYS NOT INTENDED BY Chilipoker or THE Tain Poker Network.

(ii) THE SERVICES, WEBSITE, GAMES AND THE SOFTWARE ARE PROVIDED TO YOU "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED (WHETHER BY LAW, STATUTE OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF APPLICABLE LAWS AND REGULATIONS. Chilipoker and THE Tain Poker Network DO NOT WARRANT THE FUNCTIONS CONTAINED IN THE SERVICES, THE GAMES OR THE SOFTWARE WILL MEET YOUR REQUIREMENTS, NOR THAT THEIR OPERATIONS WILL BE UNINTERUPPTED OR ERROR FREE.

(iii) THE ENTIRE RISK AS TO THE USE, QUALITY AND PERFORMANCE OF THE SERVICES, THE GAMES AND THE SOFTWARE BY YOU LIES SOLEY WITH YOU.

(iv) Chilipoker and THE Tain Poker Network WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSSES, COSTS AND EXPENSES IN CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT OR YOUR USE OF THE SERVICES THE GAMES, OR THE SOFTWARE, HOWEVER THEY ARISE, WHETHER FOR loss of business information, or any other pecuniary or consequential loss, BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF Chilipoker or THE Tain Poker Network RECEIVED PRIOR NOTICE OF THE POSSIBILITY OF SUCH DAMAGE

(v) IN NO EVENT, SHALL Chilipoker or the Tain Poker Network BE LIABLE FOR ANY MALFUNCTIONS OF THE SOFTWARE, BUGS OR VIRUSES, RESULTING IN LOST DATA OR ANY OTHER DAMAGE TO YOUR COMPUTER EQUIPMENT OR SOFTWARE. FURTHER, Tain Poker Network IS NOT REQUIRED TO PROVIDE REDUNDANT OR BACKUP NETWORK AND/OR SYSTEMS.

(vi) NOTHING IN THIS AGREEMENT WILL OPERATE SO AS TO EXCLUDE ANY LIABILITY Chilipoker or THE Tain Poker Network MAY HAVE IN RESPECT OF FRAUD OR DEATH OR PERSONAL INJURY CAUSED BY Chilipoker or THE Tain Poker Network's NEGLIGENCE

(vii) Chilipoker or THE Tain Poker Network SHALL NOT BE LIABLE FOR ANY ACTS OR OMISSIONS MADE BY USER'S INTERNET SERVICE PROVIDER WITH WHOM USERS HAVE CONTRACTED TO GAIN ACCESS TO THE SERVER THAT HOSTS THE SITE.

8. Third Party Rights

Except insofar as this Agreement expressly provides that a third party may in their own right enforce a term of this Agreement, a person who is not a party to this Agreement has no right under local law or statute to rely upon or enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available other than under local law or statute.

9. Inactive Account

If you do not access your Account by "logging in" to your Account using your Account name and password for any period of six calendar months your Account will be deemed Inactive.

10. Obligations of Chilipoker and the Tain Poker Network

(i) Chilipoker and The Tain Poker Network have no obligation to check whether players are using the Service in accordance with this Agreement or the House Rules.

(ii) Under no circumstances shall Chilipoker or the Tain Poker Network be obligated to investigate or pursue any complaints made by a player against any other player using the Service or to take any other action in connection therein, or take any action against a player for any reason, including without limitation for violating the terms of this Agreement. Chilipoker or The Tain Poker Network may, in its sole discretion, decide to take appropriate action against any person it suspects to be engaging in any unlawful behavior or otherwise violating the terms of this Agreement, but is under no obligation to do so.

(iii) You will not be entitled to a refund from Chilipoker or the Tain Poker Network for any monies owed to you as a result of any other player's misconduct, unlawful behavior or otherwise whether or not the Tain Poker Network decides to pursue any action against such user.

11. No Tain Poker Network Employees or Affiliates.

If you are an officer, director, employee, consultant or agent of the Tain Poker Network or one of its group companies, or suppliers or vendors, you are not permitted to register with the Tain Poker Network. You are not permitted to participate directly or indirectly in any of the Games (each an "Unauthorised Person"). Similarly, relatives of Unauthorised Persons are not permitted to register with Tain Poker Network or to participate directly or indirectly in any of the Games except with the written permission and authorization of the Chief Operations Officer of the Tain Poker Network. For these purposes, the term "relative" shall include (but not be limited to) any of the following spouse, partner, parent, child or sibling.

12. Collusion & Anti-Cheating Software.

(i) We are committed to detecting and preventing software programs which are designed to enable artificial intelligence ("AI Software") to play on our Services such as, but not limited to opponent-profiling, player collusion, cheating software or anything else that we deem enables you to have an unfair advantage over other players. You acknowledge that the Tain Poker Network will take measures to detect and prevent the use of such programs and AI Software using methods (including but not limited to screen scraping or reading the list of currently running programs on a player's computer) and you agree not to use any AI Software and/or any such programs. We constantly review the use of the Service in order to detect the use of such aforementioned software and in the event that we deem it has been used, we reserve the right to take any action we see fit, including immediately blocking all access to the Service to the offending User, terminating such User's account and seizing all monies held in such account. You further agree to refrain from using any hardware or software application that could be deemed to give the user an advantage or deemed unethical in the conduct of play.

(ii) Collusion: Collusion occurs when two or more players at a poker table attempt to gain an unfair advantage by sharing knowledge of their cards or other information. Any player who attempts to or colludes with any other player while using the Service may be permanently banned from using the Network or Software or any other related services of the Tain Poker Network and their account may be terminated immediately and permanently. We have developed and employ extremely sophisticated technology intended to seek out and identify players acting in collusion as well as any other fraudulent or unlawful use of the Network or Software. The Tain Poker Network will investigate complaints registered against players suspected of collusion. The Tain Poker Network is under no obligation to provide further details regarding members accused of cheating to the complainant. If the Tain Poker Network is informed during play about suspected collusive behavior, it may, in its sole discretion, terminate suspected players' access to the Service and/or block their accounts. However, under no circumstances shall the Tain Poker Network be liable for any loss, whatsoever, sustained by you as a result of the collusive, or otherwise unlawful activity of any person using the Service or the Software and no player shall have the right to require the Tain Poker Network to take any other steps against players suspected of collusion, cheating or any other form of fraud on the network. The Tain Poker Network may also share information (including, but not limited to, all details provided when registering an account with the Tain Poker Network) regarding players who have had their accounts terminated for fraudulent behaviour with any partners, affiliates and associates of the Tain Poker Network or with any Law enforcement agency.

(iii) If there is any suspicion by Chilipoker or the Tain Poker network that the Service is being used in any way as a money transfer system, then all funds in the accounts will be seized and the accounts will be terminated.

13. Fraudulent Activities

Chilipoker and The Tain Poker Network has a zero tolerance policy towards inappropriate play and fraudulent activity. If, in the Tain Poker Network's sole determination, you are found to have in any way cheated or attempted to defraud Chilipoker or the Tain Poker Network or any other user of any of the Games including but not limited to game manipulation, Chilipoker and the Tain Poker Network reserve the right to suspend and/or close your Account and to share this information (together with your identity) to other online gaming sites, and appropriate agencies.

14. Security Review

To maintain a high level of security and integrity in the system, Chilipoker reserves the right to conduct a security review at any time to validate your identity, age, the registration data provided by you, to verify your playing of the Games for potential breach of this Agreement and of applicable law. As such you authorise us and our agents to make any inquiries of you and for us to use and disclose to any third party we consider necessary to validate the information you provide to us or should provide to us in accordance with this Agreement, including but not limited to verifying the information against third party databases. In addition, to facilitate these security reviews, you agree to provide such information or documentation as Chilipoker or the Tain Poker Network, in its unfettered discretion, may request.

15. Termination

We may terminate your account (including your username and password) without notice if (i) for any reason we decide to discontinue to provide the Service, (ii) we believe that you have breached any of the terms of this Agreement, (iii) your use of the Service has been in any way improper or breaches the spirit of this Agreement, or (iv) for any other reason we see fit.

16. Indemnity

(i) You agree to fully indemnify, defend and hold us, and our officers, directors, employees, agents, contractors and suppliers, harmless immediately on demand, from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of any breach of this Agreement by you, and any other liabilities arising out of your use of the Service or Software, or use by any other person accessing the Service or Software using your user identification.

(ii) You further agree to fully indemnify, defend and hold us and our officers, directors, employees, agents, contractors and suppliers, harmless against any and all costs, expenses, liabilities and damages arising from any legal or other action taken either by or against any other user arising from any and all interaction with the Site.

17. General

(i) Chilipoker and The Tain Poker Network reserve the rights to transfer, assign, sublicense or pledge this Agreement, in whole or in part, to any person or company without notice and you will be deemed to consent to such assignment. You may not assign, sublicense or otherwise transfer or in any manner whatsoever any of your rights or obligations under this Agreement.

(ii) The relationship between you, Chilipoker and Tain Poker Network is one of independent contractors. Nothing in this Agreement shall be deemed to constitute a partnership between you and us, or create a relationship between you and us of principal and agent for any purpose.

(iii) This Agreement contains the entire agreement between you Chilipoker and Tain Poker Network relating to the Service. You confirm that, in agreeing to accept this Agreement, you have not relied on any representation save insofar as the same has expressly been made a representation in this Agreement.

(iv) We reserve the right to modify or terminate the Service or elements of the Service at any time, without notice, and we will not be liable to you as a result of any such action.

(v) If any part of this Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the rest of this Agreement and shall not affect the validity and enforceability of any of the remaining provisions of this Agreement. In such cases, the part deemed invalid or unenforceable shall be construed in a manner consistent with applicable law to reflect, as closely as possible, the original intent of the parties.
